1. Service Description
Action Mobile provides a platform allowing users to trade in their used mobile devices (“Devices”) for financial compensation. The service includes the evaluation, payment, and shipment of the devices, subject to the terms and conditions detailed herein.


2. Eligibility

By using our service, you confirm that you are at least 18 years old and have the legal authority to enter into this agreement. If you are using this service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.


3. Device Evaluation and Payment

3.1 Device Evaluation:

  • You must provide accurate information about the device being traded, including but not limited to, its make, model, condition, and specifications.

  • We reserve the right to adjust our initial estimate upon receipt and evaluation of the device. If the device’s condition or specifications vary from what was originally stated, we may revise the valuation accordingly.

  • If we make a revised valuation, you will have the right to accept or reject the new offer. If rejected, the device will be returned to you at our expense.

3.2 Payment:

  • Payment will be issued to you based on the agreed-upon valuation of your device.

  • Payment will be made using the agreed-upon method, such as PayPal, bank transfer, or store credit.

  • We are not responsible for any fees charged by payment processors or banks for processing the payment.

4. Device Shipment
4.1 Shipping Label:

  • After the device valuation is confirmed, we will provide you with a prepaid shipping label that you must use to ship the device to us.

  • You are responsible for securely packaging and protecting the device during transit.

4.2 Ownership and Risk of Loss:

  • Ownership of the device transfers to us only upon our receipt of the device.

  • You are responsible for any loss, damage, or theft of the device until it is received by us.

4.3 Delays and Non-Delivery:

  • We are not responsible for any delays or non-delivery of the device caused by incorrect information or actions by you, the shipping carrier, or any other third party.

5. Privacy and Data Security
5.1 Data Removal:

  • It is your responsibility to back up and remove any personal data from the device before shipping it to us.

  • We are not responsible for any data left on the device or for any unauthorized access to such data.

5.2 Data Security:

  • We employ industry-standard security measures to protect the personal data you provide to us during the trade-in process.

  • By using our service, you acknowledge and agree that we may process your personal data in accordance with our Privacy Policy.

6. Dispute Resolution
In the event of any dispute arising from or relating to these Terms of Service or the use of our service, both parties agree to attempt to resolve the dispute through good-faith negotiations. If the dispute cannot be resolved amicably, either party may seek resolution through binding arbitration, subject to the laws of the jurisdiction where Action Mobile operates.

 

7. Limitation of Liability

Action Mobile and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with our services. In no event shall our total liability exceed the trade-in value offered for your submitted device.
